Terms and Conditions of RetireSmart Health Service Platform
Welcome to registering as a user of the RetireSmart Health Service Online Platform (hereinafter referred to as "the Platform"). The Platform is operated by YDCare (hereinafter referred to as "the Company") to deliver tailored health management services exclusively to designated insurance company clients.
Prior to confirming your registration as a user, please carefully read the following Terms and Conditions (hereinafter referred to as "these Terms"). By clicking "Agree," you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. User Eligibility, Tiers, and Service Restrictions
- Eligibility: Platform user status is strictly restricted to designated clients who have been invited.
- Quotas and Tiers: The Platform operates under multiple user tiers. This service is available in Hong Kong and designated cities in Chinese Mainland only. Users may log into the Platform at any time to review their current tier, remaining quota, and usage records. Upon exhaustion of allocated quotas, the Company reserves the right to decline any new service bookings (excluding self-paid items).
- Account Security: User accounts are strictly for the personal use of the Primary User and authorized nominated family members. Accounts shall not be assigned, transferred, lent, or disclosed to any third party.
- Geographical Restrictions on Home Visit Services: Home visit services provided via the Platform are subject to strict territorial limitations. The Company does not provide cross-border or cross-regional home visit services. If a user is located in an unregistered or unapproved country/region, the Company reserves the right to refuse service.
2. Family Member Nomination Mechanism and Substitution Limits
- Nomination Rights and Substitution Cap: The Primary User is entitled to nominate up to two (2) nominated family members, limited to parents, spouses, and parents-in-law, to share the service benefits. The Primary User is authorized to alter the nominated family member list a maximum of two (2) times during their effective user term. The Company reserves the right to reject any substitution requests exceeding this limit.
- Legal Warranty and Authorization Guarantee: The Primary User hereby confirms, warrants, and represents that, prior to providing any personal data/information of any nominated family member, explicit consent (or "separate consent" for Chinese Mainland and Macao users) has been duly obtained from such nominated family member, authorizing the Company to collect, process, and transfer their personal data across borders.
3. Service Reservation, Confirmation, and Amendment Mechanism
- Upon receipt of a booking request, the YDCare team will contact the user for a phone consultation or health assessment to determine whether the Platform possesses the capacity to deliver the corresponding care service. The Company reserves the right to decline service if the user’s condition is assessed as unsuitable.
- Upon successful review, assessment, and arrangement, the Platform will issue a "Booking Confirmation Email." Service bookings shall be finalized solely upon the issuance of said confirmation email.
- Should a user need to modify or cancel a confirmed booking, a formal application must be submitted through designated customer service channels in accordance with the following service categories:
- At home or centre health assessment, and 1:1 online lifestyle coaching session: requests must be submitted at least 24 hours prior to the scheduled service time.
- Home-based treatment and training session: requests must be submitted at least 48 hours prior to the scheduled service time.
- If a user fails to complete the cancellation or modification notice prior to the respective deadline specified above (24 hours or 48 hours), or fails to attend the appointment on the scheduled day, the booking shall be deemed consumed. The Platform shall deduct the corresponding service quota from the Primary User's account as usual, without any entitlement to compensation, refund, or quota reinstatement.
4. Electronic Communications and Operational Notifications
- The Platform will issue essential service-related communications to you via email or push notifications.
- Opt-out does not apply to essential operational or transactional notices. The Company retains the right to send communications directly relating to booking confirmations, service reminders, schedule amendments, account security alerts, quota balance updates, or amendments to these Terms. As these notifications are indispensable to contract performance and the protection of your rights, they are not subject to unsubscribe mechanisms.
5. Self-Paid Products and Supplementary Service Terms
- Enquiries or bookings made via the Platform for products or extra health services not covered by quotas (hereinafter referred to as "Self-Paid Items") constitute independent commercial transactions directly entered into between the user and YDCare, and do not consume or deduct free service quotas.
- All fee structures, payment methods, and invoicing for Self-Paid Items shall be directly handled and collected by YDCare. Users shall complete full payment prior to service delivery via YDCare's designated methods.
6. On-Site Safety and Prohibition of Private Transactions
- Users are responsible for providing a safe and appropriate home care environment. If safety hazards exist, or if the user/nominated family member exhibits verbal/physical misconduct toward personnel, or conceals severe infectious diseases, care or professional staff reserve the right to terminate services immediately. The corresponding quota for that session shall be deducted in full.
- Users (including Primary Users and nominated family members) are strictly prohibited from engaging in private commercial transactions with, requesting personal contact details from, or privately employing any care or professional personnel dispatched by the Company.
7. Scope of Services and Disclaimer of Liability
- All health services, reports, or advice provided by the Platform are strictly for general health management and reference, and shall not serve as a substitute for professional medical diagnosis or treatment. In emergency situations, users must immediately seek medical assistance or contact local emergency services.
- The Company uses reasonable endeavors to ensure the professional qualifications of its personnel. However, to the maximum extent permitted by applicable law, the Company assumes no legal liability for any losses resulting from force majeure events, user concealment of medical history, or failure to follow professional guidance.
